Your not the average traveller and we're not the average tour company
It is important that you read all information carefully and ensure that you understand and accept the conditions outlined below before proceeding with your booking.
By booking a tour with us you are accepting these terms and conditions as a binding contract without alteration. The booking person or agent is responsible for conveying these terms to all parties partaking in the tour (customers).
Validity
Products and prices are subject to change without notice. All Exceptional Phillip Island Area Tours, prices are valid unless superseded or otherwise indicated from 1st July 2022 to 31 December 2022.
A 50% deposit is required at the time of booking and the remaining balance is due 30 days prior to the tour date unless other arrangements have been made in writing to Exceptional Phillip Island Area Tours. Payment will be accepted by our online booking system, bank transfer, credit card or by alternative arrangement by contacting our office. Bookings are not deemed final until a receipt has been issued by us.
All tours/holiday prices exclusive of GST. GST is added to the price. All fares are and in Australian currency.
CUSTOMERS RESPONSIBILITY:
In booking a tour the customer:
-
accepts the physical risks in the tour
-
must not commence the tour if they are unfit or become unfit to participate in the tour by reason of ill health or injury
-
is responsible for the safekeeping against loss and protection against damage of all personal effects of the customer, and
-
must take out travel insurance covering tour cancellations, inability to travel or continue with the tour (for whatever reason), loss or damage to personal effects, medical, evacuation and repatriation expenses, and accidental death or disability.
GENERAL INFORMATION AND BOOKING CONDITIONS
Quotes & Availability:
All bookings are subject to availability. Verbal quotes are regarded as an estimate and prices are only confirmed with a written quote. All written quotes are valid for 7 days from the date of the written quote.
Confirmation of Booking / Delivery of Ticket:
When you book a tour, you will either receive an invoice to pay by bank transfer or credit card or when you pay online, you will receive an email confirming your booking and a phone call. Acceptance of Booking
Bookings are accepted subject to the services applied for being available. Exceptional Phillip Island Area Tours, reserve the right, without notice, to cancel or modify and, or all of the arrangements and in the event the full amounts paid will be refunded to the consumer, and upon rendering the same, all liability of Exceptional Phillip Island Area Tours in respect there of shall cease. Exceptional Phillip Island Area Tours reserves the right to decline, to accept, to retain any person as a member of any party at any time.
Deposits
A minimum deposit of 50% of the total package cost per person is payable within 7 days, on confirmation of booking. The payment is made to Dilray Pty Ltd bank account.
Balance
The balance (or final payment) is due in full 30 days prior to departure. Bookings made within this period must be fully paid upon confirmation. Unless alternative payments have been made in writing with the customer and Exceptional Phillip Island Area Tours.
Cancellations and Refund Policy
Tour cancellation policy is as follows:

Between 0 (day of tour) & 7 days – no refund will be given
-
Between 8 & 30 days – 50% refund of tour price per person
-
Greater than 31 days – 15% administration fee

Payments can be refunded or transferred to another tour if cancellation is made at least 30 days prior to the tour. A credit will apply for twelve months from time the tour was cancelled by the customer.

If the tour is cancelled due to bad weather conditions, the customer has an option to rebook on another exact tour at no cost, no refund will be given. A credit will apply for twelve months from time the tour was cancelled by the customer.

Our refund policy is separate from and does not affect the warranties/protection under the Trade Practices Act

Travel insurance covering cancellation is strongly advised
-
Refunds will not be given for unused services.
If a force majeure circumstance necessitates cancellation of the tour, then:

The customer must rely upon any travel insurance they hold for compensation; and
-
Where possible, Exceptional Phillip Island Area Tours will substitute an itinerary with a similar experience.
Please note: If a tour is cancelled, the customer must rely upon any travel insurance they hold for compensation and where possible Exceptional Phillip Island Area Tours will arrange a similar tour. And if for unforeseen circumstances due to a medical problem the customer has to cancel their tour and the customer has a medical certificate, Exceptional Phillip Island Area Tours will assess each case and decide if a full refund will be given.
All public tours require a minimum number of patrons to commence (2 or 3 customers depending on the chosen tour). If these minimum numbers are not met, we reserve the right to postpone or cancel the customers booking. We will refund the total payment if a tour is cancelled. Each tour is limited to a maximum of 10 customers per tour
Insurance
It is advisable for everyone undertaking these tours and services to insure themselves against medical expenses, evacuation and repatriation expenses, and accidental death or disability, personal accident, tour/holiday cancellations, loss of deposit and cancellation fees, inability to travel or continue with the tour and also the baggage against damage, loss, theft, etc.
Credit Card Charges
A merchant fee is charged with all bookings made by credit card. This is only if you use a credit card. You have the option to pay by bank transfer without any fees If cancellation is made, the merchant fee will not be refunded.
Not Included in Costs
Cost of airfares, airport taxes, travel insurance, laundry, road tolls, telephone calls, meals (unless specified), gratitude’s and any other item of a personal nature.
Luggage
Luggage, including personal articles, is at all times and in all circumstances at owners’ risk except to the extent of any insurance by the customer.
The following applies to our Tour Gift Vouchers:

Gift vouchers are only redeemable for a tour with Exceptional Phillip Island Area Tours

Gift vouchers are not valid until they have been paid for in full and activated.

Gift vouchers have an expiry of twelve months after their purchase date. All tours must be undertaken within this twelve-month period.

We reserve the right to change the outline of tours as well as the tour price between when the gift voucher is purchased and redeemed.

Gift voucher are redeemed by email, telephone or via our booking system.
Responsibilities

Exceptional Phillip Island Area Tours will not be responsible for any reckless, accidental or negligent actions which may cause injury, damage to persons or their property.

Accepts the physical risks involved in the tour
-
All customers are to follow the instructions at all times of your tour guide.

Must not commence the tour if they are unfit or become unfit to participate in the tour by reason of ill health or injury
-
Exceptional Phillip Island Area Tours will not be liable for any items lost, damaged, misplaced or stolen during the tour/holiday.

No bottles, glass or hot liquids are allowed on any tour.
-
No drinks are allowed to be taken into any of the venues visited on any tour.

Exceptional Phillip Island Area Tours will take no liability for the actions taken by customers on the tour.

No smoking is permitted on any of tour.

Exceptional Phillip Island Area Tours will not be responsible for any claims arising out of sexual nature on any of its tours.

We accept no responsibility for and provide no refund to customers who miss any part of the tour for any reason. All customers need to be ready to be picked up at their designated time and location.

Anybody involved in any unruly behaviour run the risk of not continuing with the tour.

Customers are responsible for any damage inflicted on property during the tour. A minimum fee of $200 and a maximum of $1500 may apply to any damage or spillage in our car or bus.

Exceptional Phillip Island Area Tours has no financial interest in any of the venues we visit.

Exceptional Phillip Island Area Tours reserves the right to alter tours and or cancel tours.

Exceptional Phillip Island Area Tours may take photos and videos during your tour and use these images in promotional material including on the website and social media sites.

All tours require a minimum number of customers to commence. Please note the minimum number and maximum number of customers in all the listed tours. If these minimum numbers are not met, we reserve the right to postpone or cancel the customers booking. We will refund the total payment if a tour is cancelled by us. Each tour is limited to a maximum of 10 people per tour.

Any legal action (including fines) taken against a person on the tour, or against the tour operator (Exceptional Phillip Island Area Tours) because of the actions of a person will be the sole responsibility of that person(s).

Persons under the age of 21 years are not permitted on our wine tours without written permission from Exceptional Phillip Island Area Tours
Exceptional Phillip Island Area Tours Responsibilities
In accepting a tour booking Exceptional Phillip Island Area Tours agrees:
-
To maintain liability and indemnity insurance to cover the liabilities of customers (customers are advised to rely upon their own travel insurance in almost all instances where injury, loss or damage is suffered to themselves or their effects).

To maintain licenses and permits necessary to carry out tours/holidays.
-
To ensure personalised service on shared tours/holidays by having a maximum ratio of one tour guide per 10 customers.
Consumer Claims
Should you encounter any problems on your tour it is always better to try and solve directly with Exceptional Phillip Island Area Tours. If it is not possible to do so and you wish to lodge a complaint, please do so in writing within 30 days of completing your tour with Exceptional Phillip Island Area Tours
Accuracy
Whist every effort is made on the accuracy Exceptional Phillip Island Area Tours, cannot be held responsible or any errors, or omissions, occurring in the changes to the tickets, hotel / resort facilities or amenities as specified, during the validity of the package. Care will be taken to update on any major changes that could affect the enjoyment of your tour.
